1. Acceptance of Terms

By downloading, installing, or using the Zern application ("App") or visiting zern.toxeq.com ("Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use Zern.

2. Description of Service

Zern is an AI-powered personal productivity application that helps users plan schedules, manage tasks, and track goals. The AI assistant is powered by a third-party language model (Groq) accessed through a secure proxy.

Zern is currently provided free of charge. We reserve the right to introduce paid plans in the future, with advance notice to existing users.

3. User Accounts

• You must be at least 13 years old to create an account.
• You are responsible for maintaining the security of your account credentials.
• You may not create accounts for others without their consent.
• You may only have one account per person.

4. Acceptable Use

You agree not to use Zern to:

• Violate any applicable laws or regulations.
• Attempt to reverse-engineer, decompile, or extract secrets from the application.
• Abuse, scrape, or overload our AI proxy or backend services.
• Impersonate others or submit false account information.
• Transmit any malicious code or interfere with the service.

5. AI-Generated Content

Zern uses AI to generate suggestions, schedules, and responses. AI-generated content is provided for convenience and informational purposes only.

• We do not guarantee the accuracy, completeness, or fitness of any AI output for a particular purpose.
• AI responses should not be treated as professional medical, legal, financial, or other expert advice.
• You are solely responsible for decisions made based on AI suggestions.

6. Intellectual Property

The Zern name, logo, app design, and website are owned by Aksel / TOXEQ and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our explicit written permission.

Your personal data (tasks, schedules, notes) belongs to you. We claim no ownership over content you create in Zern.

7. Availability & Changes

We aim to keep Zern available and reliable, but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features at any time. Where reasonably possible, we will provide advance notice of significant changes.

8. Disclaimer of Warranties

Zern is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, Zern or its content.

10. Account Termination

You may delete your account at any time via the Account Deletion page. We reserve the right to suspend or terminate accounts that violate these Terms.

11. Governing Law

These Terms are governed by the laws of Sweden, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of Swedish courts.
